Pursuant to K.S.A. 45-215 et seq., all records maintained by the City of Abilene, Kansas must be open for inspection by the public. The Kansas Open Records Act (KORA) defines public records as “any recorded information, regardless of form or characteristics, which is made, maintained or kept by or is in the possession of any public agency.” As a governmental agency, the City of Abilene is required to comply with the guidelines as set forth in the KORA.
KORA provides for limited exceptions to the public disclosure requirement. Such exceptions include, but are not limited to:
1) personnel records of public employees, medical treatment records, records protected by attorney/client privilege, and certain utility service information;
2) records closed by the rules of evidence, records containing personal information compiled for census purposes; and 3) notes and preliminary drafts, and criminal investigation records. A complete list of exceptions may be found in K.S.A. 45-221, but other state and federal statutes may also restrict access to certain records.
Members of the public are advised that all requests for information or complaints provided to the City are subject to public disclosure under the Kansas Open Records Act.
